These Terms of Service ("Terms") govern your use of the SIMDIN application and website at simdin.ai (the "Service") operated by SIMDIN ("we," "our," or "us"). By accessing or using the Service, you agree to be bound by these Terms.

1. Eligibility

You must be at least 13 years old to use the Service. If you are under 18, you must have parental or guardian consent.

2. Account Registration

You must provide accurate information when creating an account. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. Notify us immediately at [email protected] if you suspect unauthorized access.

3. Subscription and Billing

  • SIMDIN offers paid subscription plans (Starter, Pro, Family) with pricing as displayed on our pricing page.
  • All plans include a 14-day free trial.
  • Subscriptions renew automatically each month. You can cancel at any time from your account settings.
  • Cancellation takes effect at the end of the current billing period. No refunds are provided for partial months.
  • We reserve the right to change pricing with 30 days' notice.

4. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose
  • Attempt to reverse-engineer, decompile, or extract source code from the Service
  • Interfere with or disrupt the Service's infrastructure
  • Scrape, crawl, or harvest data from the Service without authorization
  • Share your account credentials with third parties
  • Use automated tools to access the Service beyond normal usage patterns

5. Intellectual Property

The Service, including its design, code, content, and branding, is owned by SIMDIN and protected by intellectual property laws. You retain ownership of the data you provide (preferences, ratings, etc.) but grant us a license to use it to operate and improve the Service.

6. Third-Party Integrations

The Service may integrate with third-party services (e.g., Kroger). Your use of those services is governed by their respective terms and privacy policies. We are not responsible for the availability, accuracy, or practices of third-party services.

7. Nutritional Disclaimer

Meal plans, recipes, and nutritional information provided by the Service are for informational purposes only. They are not medical or dietary advice. Consult a healthcare professional before making significant dietary changes, especially if you have allergies, medical conditions, or are pregnant or nursing.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SIMDIN SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

10. Indemnification

You agree to indemnify and hold harmless SIMDIN and its officers, employees, and agents from any claims, liabilities, damages, or expenses arising from your use of the Service or violation of these Terms.

11. Termination

We may suspend or terminate your account if you violate these Terms. You may delete your account at any time from your settings page. Upon termination, your data will be deleted within 30 days.

12. Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles.

13. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page. Continued use of the Service after changes constitutes acceptance of the revised Terms.
